Insurance Question: I Was Hit In My Car By Another Driver 2 Weeks Ago. Nobody Was Hurt But Our Car Was Totaled
Our car was totaled by another driver 2 weeks ago. That driver only has liability as do us. I called 911 at the scene of the accident but the police department cannot find the police report for us. Geico’s adjuster, the guy who hit us’s insurance company, says he cannot do anything without the police report. I filed an accident report as required by New York State. I faxed that to him and our local police department told me that, the accident report I filed, should be of same weight as a police report in insurance claims. Now the Geico adjuster will not do anything without a police report. What are my options? Should I begin a law suit against Geico to get our money back? I have presented as much evidence as I can to Geico but this adjuster will not do anything without a police report. And the police department does not have a police report for us. Should I search for the 911 call record? Fire Department records? under the Freedom of Information Act? Thanks for any help!

Start with the the 911 dispatch report and then get the name of the officers who responded. They may be able to find their paper work and help you out. You may need the help of a county commissioner or
city council man to get the police to get that report for you. You could also put a free ad in the paper to find any witnesses to the accident.
I am sorry this is such a hassle for you, but at least you weren’t injured, laid up and trying to fight your way through this.

Suing Geico for damages isn’t going to help – they didn’t hit you.
You have to sue the guy that hit you.
That accident report should be all you need.
A couple things to discuss with your agent: is there any possibility that YOU are at fault for this, in accordance with your state standards of fault? And, what do you do if that Geico policy doesn’t cover the guy that was driving? You could be SOL – even if you get the judgement, you might not be able to collect any cash.
