Is It Legal For You To Get An Auto Insurance Ticket If Your In You Car, But Parked In A Public Place?
The situation was that my buddy got a ticket for no insurance while sitting in his car. He was just sitting in the drivers seat reading a magazine and the cop approached him and asked for his driver lisence and insurance. And this was in a public area.

Yep, any vehicle operated on a public right of way or public parking lot has to have insurance. I’m pretty sure your friend didn’t carry the car there and set it down, so it is pretty obvious it was driven. However, the requirement is that licensed vehicles have insurance, so whether it is sitting or moving, insurance is required.

In most jurisdictions, the police officer would need a reason to approach the driver in the first place. He just can’t walk up and do random ID checks without probable cause that there is some sort of violation going on. If your friend was legally parked and not violating any other laws, I would question the purpose and reason the policeman used to make contact in the first place.

If a car is parked in a public area, and someone is sitting in the vehicle, there is a reasonable expectation that it was driven there. The law is most jurisdictions requires you to carry proof of insurance, and to show it on demand to any peace officer.
If a car is driven, or parked in any public area, insurance is required.
Why would you even wonder about it?
Added: Jetdoc, the courts have long supported the random check, either as a formal road block where every vehicle is checked, or the concept of stopping and checking a vehicle at random. In this case he was already stopped, and the random check of license, registration and insurance was legal and appropriate.

Well yes, he will get in trouble for not having insurance. But I’d be questioning the officer why he would want to check for my driver license and insurance.
